The user acknowledges that he/she has read these general terms of use and undertakes to comply with them.

EURL LOIRE ATTITUDE reserves the right to modify the present notice at any time.

The user therefore undertakes to consult it regularly.

In the event that you access the https://www.loire-attitude.fr portal from a country other than France, you undertake to ensure that you also comply with the locally applicable legislation.

GENERAL TERMS AND CONDITIONS OF SALE

PREAMBLE

The present conditions are concluded exclusively between the company EURL LOIRE ATTITUDE registered in the RCS of ANGERS under the number 884 069 998, whose head office is located in BOUCHEMAINE (49080) - 13, chemin du Patis, - France, hereinafter referred to as "Boutique www.loire-attitude.fr" and any person making a purchase on the site www.loire-attitude.fr, hereinafter referred to as "the Customer" and collectively referred to as "the parties".

The Customer declares that he/she is of legal age or has parental consent and that he/she has the legal capacity to enter into a contract, thus enabling him/her to place an order on https://www.loire-attitude.fr.

The characteristics of the rented products or services on the website are indicated on the product sheet.

The website https://www.loire-attitude.fr reserves the right to modify or change the pages of the website, the products offered, their prices and the photographs presented.

For any question related to an online purchase, LOIRE ATTITUDE can be reached via the contact form at the bottom of the site "contact".

The Parties agree that their relations will be governed exclusively by these general terms and conditions of sale, which are available on the website https://www.loire-attitude.fr

These conditions are subject to change.

Therefore, it is understood that the applicable conditions are those in force on the site at the time of the order placement on the LOIRE ATTITUDE site. The date of the online publication of these General Terms of Sale is the date of their implementation.

ORDER

Placing an order is done in several steps:

- the Customer fills in the information request form concerning him/her, without which the order cannot be validated - this information is decisive for the choice of the product ordered and if the Customer has given erroneous information resulting in the order of an unsuitable product leading to the need for an exchange or a return, the exchange will be made at the Customer's expense and no reimbursement will be made,

- the Customer fills his basket of products,

- the Customer chooses the method of payment,

- the Customer makes the payment request,

- The Customer then receives an e-mail from https://www.loire-attitude.fr to register his order,

- Finally, the Customer receives an e-mail validating the order.

The order validation e-mail signifies acceptance by https://www.loire-attitude.fr of the Customer's order and thus forms the sales contract between the parties.

As soon as the order is ready for shipment, www.loire-attitude.fr will send an order dispatch e-mail to the Customer.

ARTICLE

The prices displayed by default on the site are indicated in euros and include all charges applicable in Metropolitan France.

VAT is charged at the rate applicable at the time the order is placed.

The Customer will be informed of the latter on the summary screen before the order is finally validated.

Method of payment :

- secure online payment STRIPE payment by credit card: choose the type of credit card, enter your card number, its expiry date and the visual cryptogram (the last three digits appearing on the signature panel on the back of your credit card), then validate by pressing the "validate" button (2nd click).

Your "2nd click" will allow LOIRE ATTITUDE to register your order.

The acceptance of your order by LOIRE ATTITUDE will be effective only after the acceptance of your payment by your bank, shown by the STRIPE screen of transaction confirmation.

The total amount of your order will then be debited from your bank account according to the conditions of your credit card contract. In the contrary case (refusal of your payment by your bank), the order will be cancelled by LOIRE ATTITUDE.

Please note: when using STRIPE's secure online credit card payment, your card number will never be communicated to us.

The transmission of your payment information is encrypted and secure thanks to the PCI DSS (Payment Card Industry Data Security Standards) which is the most secure standard used by almost all e-commerce sites. Your payment data will never circulate in clear text on the Internet. We will not store any banking data. You can therefore pay online in complete security.

As soon as your order form is registered, as indicated above, we will send you an e-mail confirming your order and summarising all the elements relating to it. By printing and/or keeping this e-mail, you will have a means of proof of your order and of our acceptance of it.

PROOF OF PAYMENT / ORDER

In the absence of proof to the contrary, our computer records and those of our service providers, kept under reasonable security conditions, will constitute proof of all transactions between www.loire-attitude.fr and the Customer. In accordance with the regulations, we archive orders on a reliable medium. The Customer may access this on the https://www.loire-attitude.fr website in the "My account" area. In any case, we recommend that the Customer keep the order validation e-mail.

AVAILABILITY

Our product and price offers are valid as long as they are visible on the site, except for special operations whose validity period is specified on the site. The Customer is invited to consult the availability of the items sold on the information page of each product.

In the event of an order for an item that proves to be unavailable, www.loire-attitude.fr reserves the right to cancel the order subject to notifying the Customer.

In the case of an order for several products, if one of the products proves to be unavailable within the timeframe announced on the site, www.loire-attitude.fr will inform the Customer of this additional delay. The entire order will only be processed and shipped when all the products in the order are available, unless the Customer decides to receive the available items in the order first. In this case, the Customer will only be charged the shipping costs announced at the time of the order for the two deliveries.

The Customer may also opt for the partial cancellation of his order if the products concerned are unavailable or the total cancellation of his order. In both cases, these cancellations will be possible provided that the Customer Service Department https://www.loire-attitude.fr is informed in advance by telephone or by email.

DURATION OF PROVISION

The rental is agreed for a fixed period. If the date or time specified on the "Rental Contract" is exceeded, an additional day will automatically be charged, the amount of which is indicated on the "Rental Contract". Any day started is due.
In the event of an extension of the rental period accepted by the Hirer, the Hirer will be invoiced according to the rates in force. Additional insurance policies taken out at the time of departure will be tacitly extended for the additional time authorised.

The Hirer reserves the right to refuse any extension without compensation for the Hirer and with the obligation for the latter to return the motorbike on the date initially foreseen on the "Rental Contract" under penalty of legal proceedings for misappropriation and breach of trust.

BREAKDOWN, ACCIDENT, PUNCTURE, ASSISTANCE

In the event of a breakdown, accident or puncture occurring during the rental period and immobilising the bicycle, the Renter benefits from the assistance service approved by the Renter; the bicycle will then be towed and/or repaired. This assistance service is reserved for the driver and any passenger. Assistance may only be requested once per Renter. If the Hirer refuses the solutions proposed by the assistance service, for whatever reason, the Hirer may not claim any reimbursement of his expenses, either from the assistance service or from the Hirer.
In the event of an accident or puncture, the Hirer will not be reimbursed for any days not used or for any loss of partial use.
In the event of abandonment of the bicycle, whatever the cause, the Renter will invoice the Hirer for the repatriation costs stipulated in the "Rental Contract".

ADDITIONAL COSTS

Before the start of the rental period, the Tenant must pay a deposit of the amount indicated on the "Rental Contract".

The Hirer reserves the right to collect all or part of this sum in the following cases: Accident, damage, theft, fire, loss of the bike, non-return of one or more accessories, extra day and additional services not paid before departure.
The Hirer agrees in advance that the Hirer may deduct the sums due for the additional costs from his bank account by means of the pre-authorised bank transfer used for the deposit or that he may cash the deposit cheque to pay these costs.

JURISDICTION

Subject to the legislation in force, the Commercial Court of Angers shall have sole jurisdiction to recognise any dispute relating to the present contract concluded.
The Hirer may however waive the benefit of the present jurisdiction clause which is stipulated in his favour. In this case, the disputes will be brought before the territorially competent courts according to common law.

INFORMATION AND FREEDOMS

Personal information concerning individuals, collected for the purposes of the Contract, shall be communicated to the Commission Nationale de l'Informatique et des Libertés and shall only be used for the purposes of administrative management or commercial actions or to meet legal or regulatory obligations.

They may give rise to the exercise of the right of access and rectification under the conditions provided for by law 78-17 relating to information technology, files and freedoms, of 6 January 1978. To exercise this right, please write to the following e-mail address: seb@loire-attitude.fr

In accordance with article L 223-2 of the French Consumer Code, the non-professional Tenant is informed that if he/she does not wish to be the subject of commercial prospecting by telephone, he/she can register free of charge on a list of opposition to telephone canvassing on the website www.bloctel.gouv.fr
